By her own account, the woman who was shot wasn't an innocent bystander or someone casually "trying to leave." She was leading the protest - with a vehicle - and deliberately blocking law enforcement. Her words: Woman: They clearly wanted her out of there becauseshe was the main car leading the protest, is my understanding. I talked to another guy who was driving behind her, but she was very--she was very successful in blocking traffic. She was doing what she was set out to do. No, ICE (Immigration and Customs Enforcement) does not have civil immigration jurisdiction over U.S. citizens; by law, they cannot arrest or deport citizens, but they can detain them temporarily if citizenship isn't proven, especially if interacting with local law enforcement. Citizens should always state they are citizens and can request a lawyer if questioned, as ICE agents have authority over non-citizens for immigration violations, not citizens.

After she had 1) interfered with and obstructed law enforcement by 2) criminally impeding the roadway and 3) refusing lawful orders until 4) she made a conscious decision to shift gears (again), but from reverse to drive, and accelerated her vehicle toward a police officer, 5) ultimately resulting in her demise during the commission of her act of violence in furtherance of unlawful and criminal behavior. Here ya go... this is the Law... Precedent was set in the case of Kirby v. Duva 2008 which states that deadly force cannot be used to prevent the escape of an unarmed, non-dangerous fleeing suspect. The ruling also supports the idea that an officer's use of deadly force may be deemed excessive if the officer UNREASONABLY PLACES THEMSELVES in harm's way in the first place, rather than utilizing safer alternatives.
