The case this is based on showed the nurse was in the right. She sued and won big $. They didn't have a warrant to draw the patient's blood and she was upholding the law that says the patient must consent.
So this cop will be In plenty trouble. He can not make the nurse administer the test. The nurse doesn't want to be sued and lose his job for administering the test. It is not the nurses job to do what the cop wants. There are rules and regulations.
In most if not all states you agree to these tests as a condition of having a driver’s license. No warrant needed. It’s called implied consent.
This was the right decision by law enforcement!!

the police don't run anything in a hospital in order to keep his license and his insurance and his job at that hospital he can only be directed by another doctor or the head nurse. he is not in a position legally or professionally in any way to go beyond that. I've seen the police arrest or at least try to make an arrest stick with the nurse in order to pressure him to do it. that guy's lucky he just made Bank because he can now sue them because it is unconstitutional because the man committed no crime him not taking orders from a police officer is not a crime they'll learn this later police officers are not the brightest people in the world otherwise they'd be detectives Chief of Police prosecutors senators congressman.

If they refused a field sobriety test then they have to go get their blood drawn. They are given that opportunity to choose one or the other. What the patient can't do is drive drunk & then tie law enforcement's hands from upholding that law.
