He can be charged for an open bottle, running from police and obstruction but the dui would be a hard case to present because there is no way to prove beyond a shadow of a doubt that he was drunk driving, unless prior to the video there was some sort of evidence, like if he was seen driving erratically then was pulled over then ran, a prosecutor could make the argument that he was likely drunk before then but if not he won’t be charged for a dui because he stepped out of the car then downed the rest of the bottle, this isn’t a fool proof thing tho, they could go through video and see if the bottle was empty any then the argument alongside reckless driving and the judge could accept that depending , it really hangs on if he was driving erratically and if that’s why he was stopped because if he was stopped for driving erratically then ran, it’s more then enough to make a case he was drunk driving and him chugging the bottle after wouldn’t help
