This has been happening since before I was born. They convict them everyday. Law is not about right and wrong it's about power and money.
Keys must in the ignition for a DWI. Not DUI.

Kid was 💯 correct. However if one is asleep in the car while being under the influence, and the keys are in the ignition even if the subject was in the back seat they can be charged with DUI. I've done this a couple times myself, and I would always put my keys in the center counsel or the glove box. Got woken up a couple times, but after I told them what was going on, and showed them where my keys were. They actually would usually thank me for being responsible, and to have a good night.
Shoot in fla they intent to drive drunk. if you are within x amount of ur car with your keys . talk about a police state . we have a saying here . Come on vacation go back on probation

the key s have to be in the ignition for a DUI that's what I thought he did the right thing don't charge him for that
my only DUI was 43 yrs ago. I knew I couldn't drive so put keys on radiator and got back in car to sleep. was woke being drug out of car by female cop. was arrested, jailed and had my $300.00 just cashed paycheck $$ stolen. cop let my friend also sleeping take my car that she crashed on way home. turns out cop was being investigated for stealing $$ from others. never got my $$ back.
That's today's law enforcement for ya! They're not out there to protect the public. That stopped years ago. Nowadays, they're out there to bring in money for the city, and, make as many arrests as they possibly can! Arrests and tickets!

That happened to a freind that act got out of his car and slept underneath it to keep warm by the exhaust system. He was charged with drunk on or around a vehicle. It was in a rest stop. the car was another running at the time. The idiot CHP should have told him to sleep inside till he was sober. Instead they wrote him a ticket for being responsible.
