It's been proven from the video that Pretti was recording with his PHONE! He was a lawful gun owner holding a valid Minnesota permit to carry a firearm. While some federal officials criticized the presence of a gun at a protest, Minnesota law does not prohibit permit holders from carrying firearms at such events.

He was across the street from where they were, holding his cellphone. No gun in sight. Whatsoever. The oh-so-brave ICE agents brought him to the ground, searched him, found that he had a holstered gun inside his coat. IOW, it was not in his hands or easily accessible. Two agents then fired 10 rounds into his back and killed him. While he was still prone and immobilized.
