So this cop will be In plenty trouble. He can not make the nurse administer the test. The nurse doesn't want to be sued and lose his job for administering the test. It is not the nurses job to do what the cop wants. There are rules and regulations.

If the patient doesn’t consent they need to get a court order.

I did these all of the time when I worked ER. No biggie. What the heck is his problem? I don't get him. Where is the morality stance on a blood draw?

y'all act like the DRIVER WHO DIED doesn't have rights?? Damn, you kill my friend, mom, or daughter I want DEFINITE PROOF you were drunk n that's where the blood draw comes in. Why would you "stand up" for anyone drinking & driving that results in a death. You choose to drive drunk these are the consequences. The nurse needs to just do their job. Now it MAY be different state to state but if I'm that nurse I'm not getting arrested & putting my career on the line for your drunk ass, sorry. People today are becoming so obsessed with "rights" that you defend all the people at fault too, it's awful. I wonder how this family feels about their dead family member?

most states do the blood draw at the hospital if they refuse the breathalyzer. it is an automatic (depending on the State) but I don't understand this situation with the nurse. I've never heard of anybody refusing to do a blood draw for a DUI fatality???

A nurse, Alex Wubbels, was famously arrested in 2017 at the University of Utah Hospital for refusing to draw blood from an unconscious patient for a police officer, citing hospital policy and law requiring a warrant or consent, leading to a viral bodycam video, police apologies, an internal investigation, and a $500,000 settlement with the city and university. The officer, Detective Jeff Payne, was fired, and the incident sparked national debate on patient rights, police procedure, and the nurse's ethical duty, resulting in policy changes.

I didn't realize as someone in the medical field you could get arrested for refusing to complete any task, perhaps fired but arrested? weird

when it comes to manslaughter another words someone dying in a car accident like this, the person who caused the accident will always be tested. As far as waiting for a court order, they are more concerned with getting it in a timely fashion based off the amount of time it takes for alcohol to leave a person's blood stream so that prob overrides any court order. I mean if one of your love ones God forbid lost their life to a drunk driver would you want them to wait for a court order to test the one responsible?

Yes it was inspired by a true story and the nurse was well compensated and the police officer that did it was fired why don't you put that in your article instead of just giving people part of the story

Im not a lawyer by any means , so I don't know which is true. But I will speak my own opinion and go with the fact that I think the cop is wrong. But hey, like I said before, I'm not a lawyer. so what do I know...
