So this cop will be In plenty trouble. He can not make the nurse administer the test. The nurse doesn't want to be sued and lose his job for administering the test. It is not the nurses job to do what the cop wants. There are rules and regulations.
If the patient doesn’t consent they need to get a court order.

most nurses DNT do lab draws. There are phlebotomists to do that.

As far as waiting for a court order, they are more concerned with getting it in a timely fashion based off the amount of time it takes for alcohol to leave a person's blood stream so that prob overrides any court order. I mean if one of your love ones God forbid lost their life to a drunk driver would you want them to wait for a court order to test the one responsible?

if a patient refuses we cannot force ourselves on a patient that is assault we will be charged with assault. in order to proceed with the officer's requirement he needs to show us a court order.
