So this cop will be In plenty trouble. He can not make the nurse administer the test. The nurse doesn't want to be sued and lose his job for administering the test. It is not the nurses job to do what the cop wants. There are rules and regulations.
If the patient doesn’t consent they need to get a court order.

most nurses DNT do lab draws. There are phlebotomists to do that.
most states do the blood draw at the hospital if they refuse the breathalyzer. it is an automatic (depending on the State) but I don't understand this situation with the nurse. I've never heard of anybody refusing to do a blood draw for a DUI fatality???

I mean if I’m a medical professional and a patient wont consent, I’m not going to forcefully perform any medical procedure on them just because another person tells me to. Get a court order. For all I know, this is just some dude pretending to be a cop and is trying to victimize someone else.

I'm not an attorney but I did do legal research for a law firm and I'm fairly certain the cop has no authority in a hospital when it comes to patient care and at the point of taking a blood test the phlebotomist would be in charge and have every right of refusal. But like I said I'm not an attorney. 🤷🏻♂️
this cop needs to be fired. This guy by law can't draw blood without a warrant or court order. This cop can answer should be arrested for violating this guys' 14th Amendment. it's tragic that someone was killed, but this nurse has laws that he needs to follow. This cop needs to be fired and charged, and his certification pulled for life along with his training officer fired also for not training him properly. this is a lawsuit the city can't win, and this cop loses his Qualified Immunity and can and will be held libel personally.
