That is a judicial decision made by a court. That's how things are supposed to work in due process. Homan does is not the judge. He doesn't get to remove them without a courts input. Here's an idea. Park your ICE agents in the immigration courts. If the judge denies the asylum claim, then you ask for an immediate order of removal, take them into custody, and remove them when the judge signs the order.
