The question posed to the court was not, are tariffs good or bad. It was, can the President impose Tarriffs under the authority of the Emergency Powers Act. Their answer was no, although I do believe they were swayed by the entrench republicans who are not in favor of any tarriffs n because they cut into their ability to increase profits, by favoring foreign manufacturing and cheap labor.
