The criteria for removal isn't focused on past criminal activity. That's simply a reason for expedited removal. The only factor that matters is being subject to deportation. A person can be a saint but if here illegally they are subject to deportation. Their circumstances or family ties have no bearing. If such people actually want legal status they should self deport and begin the lawful persuit of legal entry into the country in their native country. Deportation makes reentry virtually impossible under current law. Media campaigns and attempts at legal gymnastics cannot change what is established immigration laws
