This Senator doesn't know what the hell he's saying. Tell him to read the of the Constitution. WE THE PEOPLE OF THE UNITED STATES OF AMERICA TO OURSELVES AND OUR POSTERITY, posterity means our children and their children, it doesn't mean illegal aliens and their children. So, one parent must be a citizen or legal resident of the United States, meaning have a green card, and if not they do not have Constitutional Rights at all, including they don't have the right to due process at all.

If you want to be 100% technical.Anyone who is entered the united states without official permission who is a foreign national has committed an intrusion the same as an invasion of military which means they have NO RIGHTS UNDER THE CONSTITUTION OF THE UNITED STATES.... Only foreign nationals who enter the United States through proper legal channels are granted rights under the constitution.... Any foreign national who invades the United States illegally by merely crossing the border and entering the United States has committed exactly that..... there are no rights or liberties granted to anyone who invades the United States. Infiltration of the United States by foreign nationals is an invasion.... it's that simple!!! German and Italian prisoners of war, all prisoners of war bivouacked in the United States had no rights under the Constitution because they were foreign nationals. Any rights they might have fall under the geneva convention.... maybe!?!
