I think his assessment is correct and to add to it, at least one camera angle seems to show him reaching towards his gun. This is a tragic situation that never had to happen. If he had stayed home, minding his business, he would never have been in a physical conflict with ICE officers.

you can watch the ice officer take the man's pistol out of his holster from the middle of his back the ice officer turns around takes a step in the man shot 10 times in the back there was no threat he was on the ground face first and was never brandishing a firearm it was a cell phone
And the 2 officers who fired their weapons can look us in the eyes and explain to us that a man laying face first looking down at the ground and being held by 3, 4, or 5 other officers with no weapon in his hands made them fear for their lives exactly how and so they had no choice but to shoot him in the back. And some guy goes on TV and says 999 out of 1000 times it's justified.
