The pedestrian took one step back then waved at driver like hey do you see me? Doesn’t matter if pedestrians are not in road, if they are ready to cross they have the right of way. Check your state’s pedestrian crossing rules. Rules may be different for other states. California and Massachusetts have strict rules.
I always look behind me to see if theres traffic and try to wave a vehicle in front of me to go. If its clear they can turn faster then I can cross. I wont even break stride while they have to wait for me long enough to drive a qtr block.

Years ago while walking with my young son and wife, a UPS driver wouldn’t allow us to cross in a parking lot while going to the movies. He just kept coming, causing us to jump back. He delivered to the movie theater where I confronted him and he apologized and admitted that he was wrong.
