He doesn't own the water but if he owns both sides then he owns whats below the water, the cop was kinda right but he forgot to mention that as long as you are in a boat kayak canoe and you can navigate the water then yes you can go up or down the river but soon as you step foot on ground weather there's water above it or not you're trespassing. Trust Me!

They seem like good kids that like the outdoors. I own property , I ran into some good kids making a fort on it . Didn’t bother me a bit , I told them to be careful and just take care of trash. It’s good to see the younger generations enjoy the beautiful country.

you generally don't own the water in a river, even if your land borders it; you own the land up to the water, and your rights (Riparian Rights) grant you reasonable access and use of the water, but the water itself (especially in navigable rivers) and the riverbed are usually public or state property, with specific state laws determining exact ownership and usage. You have rights to use the water (like for irrigation or swimming) but can't stop others or contaminate it, and navigability makes a big difference in public access. Key

Nope, he doesn’t own running water through his property. He may own the land that it runs through or a lake on his property, but you cannot own running water through a property and it is indeed property of the state.

Sir, if it’s navigable, it’s not yours. It’s the federal government. That why many HOA’s can’t make lakes private even though their HOA surrounds the lake. If there is a stream running through it and you can go put a boat/floatable device on it, it’s the federal government’s. The rules go so far as to say that a public easement must be available to the lake if it navigable.

I see a lot of people have no understanding of property rights & public rights. I'll keep this short to help educate everyone because I wasn't sure myself. I always research before I comment on anything even if I think I know the answer. A person may theoretically be able to walk up the middle of the river without the owner being able to stop them, if the river is legally classified as navigable and the person stays strictly within the boundaries of the public easement (the riverbed/water). However, if the river is classified as non-navigable, access may be restricted.  For specific legal guidance relevant to a particular location, it is important to consult local or state laws. Both of these young men spoke to law enforcement & even have clear evidence, as it was recorded, supporting their right to be in the water & fishing the water. It is clearly a navigable river & the water belongs to the public.
