never ever will a train or operator be responsible or liable for any death or accident with a train. trains cant move left or right when they want. they also take forever to stop. so as long as the tracks are up to code and safe and the conductor uses the horn at every intersection (like that makes a difference) then the rail road company is not liable.

As a train driver here you should NEVER and I mean NEVER go onto the tracks so the woman is at fault because she thought phone was more then life and this also means the women didn’t look both ways. She should have saw the light coming.
Had family that married a train operator, dude told story’s how they use to keep going until the end of their shift, was the brains and blood of the train at the end of their shift day… idk u would honestly walk out in front of a train to begin with honestly….. but again most trains and I mean big train. Not trolleys either, buttttt my point is most trains won’t or can’t just stop in what maybe 2 to 10secs…… doesn’t just work like that. Her walking out couldn’t be saved unless she would have paid close attention…… plus u can’t he react to hitting her before actually hitting her.
