Wrong! lf an officer has probable cause they need neither and are free to search the car using a K-9. Also if a firearm is laying in plain site that is ILLEGAL AND MORE THAN ENOUGH PROBABLE CAUSE. I dont know what state you live in. but in new mexico I can open carry any rifle with a barrel of 16 inches or over. or a shotgun with an 18 inch barrel. and at 19 I can open carry that pistol right there. plain view walking down the street. trust me I know. ive been stopped by cops for it. but I have never been charged with anything because im intelligent. it is not illegal for my gun to be in view of police or civilians. unless I am not present. EXPLICITLY ONLY WHEN I AM NOT IN THE CAR CAN MY FIRE ARM NOT BE IN PLAIN VEIW. and its obviously so my car doesn't get broken into and a criminal gets a free gun. USE THE BRAIN YOU WERE GIVEN.

This is in Florida and as of July of 2023 you do not have to have a permit to carry this type of weapon in your car but you do have to have it encased whether glove box, holster, or case and not readily available like this person had in there passenger seat. Under Florida’s automobile exception to warrant law if a gun is in plain view (it is cause they saw it) it can be seized. No violation of rights here, encase the damn weapon.

I don't know any state that allows you to have that style of weapon with the clip anywhere near it. when I transport my guns they either have to be in my trunk or in separate parts of my vehicle such as the glove box and the trunk, but ammo cannot be in the gun or stored next to it
