good for them. I will play devil's advocate here and say that $951 million seems a little excessive. I mean the child survived she's just mentally handicapped which I believe does deserve the hospital taking responsibility and paying the family, but a billion dollars? there are people everywhere who have had situations this bad and worse who didn't receive even a fraction of that amount... just saying
I had an accident last April. I couldn’t stand or walk. I was bedridden. The Dr.s sent me for x-rays. Everything fine, nothing broken. I was in a wheelchair for a month in terrible pain. I made another appointment with Orthopedics and they discovered I had a broken hip and femur. Had to have surgery immediately, because the broken bone had moved close to the femoral artery. I could have bled to death in my sleep.
I should had sue when they cut me open for my C-section and they didn't give me enough anesthesia and I could feel them cut me open. I was in so much pain afterwards from my muscles tightened up so hard. I could feel that cold knife just sliced me. It was a clean slice. I could feel I was screaming my head off and they couldn't hear me. Which caused them to hurry up and pull the baby out and she was flipped, and so when she got pulled out, her legs were dislocated from her hip. I never thought that that might've been because of not getting enough anesthesia caused her legs to be dislocated from her hip because he had to hurry up and rush. So the next time I had a baby they had to head at the hospital there when I delivered. Of course, cause I didn't sue them.... why am I not so smart. I could add $1 billion.💕

it's because they are white. A hospital somehow let a doctor who didn't even work their deliver a young black couples baby, she snapped the babies neck during delivery and killed the child. Parents got nowhere hear what they deserved. It always happens like this but yet you have ppl crying that race doesn't play a factor in judicial judgements
I have a friend that went through the same thing and she didn't get close to that and her child is in a special wheelchair and has to be fed through a feeding tube in her stomach she can't speak or anything.... pretty damn sad....

That is a ridiculous amount and it will never stand. An appeals judge will strike it down for a more reasonable amount.

I just googled and the story is legitimate. Happened in the state of Utah. They have a very disabled 5 year old who was the victim of the botched delivery. The same thing happened to the sister of my best friend. Their son lived to see 12 years old. With their award they were able to buy a large home in an upscale suburban area. They renovated one side of the house for the specific use for the child. Everything was scaled to give him access to his bedroom and a specially designed bathroom. He had a day nurse and a night nurse. He was loved by family and friends so much. RIP little James. 💕

As crazy as it sounds body parts have a price in the payout. A finger,a hand and arm, leg or eye all have caps on their payout.
these settlement amounts are obscene. there needs to be legislation limiting court award amounts to a realistic amount rather than encouraging people to sue for enough money for generations to waste.

Former Labor and Delivery nurse posting. The same article is being posted by several media outlets. They all have a stupid error, in which they say the baby's blood pressure was elevated during labor. The mother's blood pressure is monitored, but only the baby's heartrate is monitored. I do believe there were errors made, but I would like to know if there's documentation showing how much effort the nurses made to communicate the situation with the sleeping doctor. Is there anyway that the nurses are being made into scapegoats?

Utah is at the bottom of the list of education, income, professionals etc.While at the top of the list for crime,infant mortality etc. They were also against masks during COVID. So to have a child in a place where they barely believe in medicine is kind of a red flag in itself isnt it?!?!? Either way,be prepared to hear more stories soon connected to red states. My daughter suffered a asthma related heart attack and was left disabled due to lack of care at age 17. Unless you have suffered a loss like this, you have no idea the amount of care, supplies paid for out of pocket, pain and anguish all the family members go through. These hospitals need to be held accountable, just like citizens who commit every day crimes. It's a shame they get to hide behind lawyers and red tape, while regular criminals don't.

Now, years later, Azaylee has seizures, developmental disabilities, facial scarring, and mental health and mood challenges. She is nonverbal.
