Photographing people in public is perfectly legal. However, businesses (and that includes hospitals) have the right to ban the taking of photographs in their respective establishments. Businesses are a private entity and they can establish their own set of rules. Having said that, it's hard to believe he could get arrested for that, however they did say 'battery' as well. And, that is an arrestable offense.
