an arrest cannot be resisted once effectuated .. this means that once handcuffs or other restraints are placed on an individual he is past the arrest stage and is now to be considered in custody. it doesn't matter what that man did to be arrested, the police have no existing custom and policy that allows them under the color of law to carry out cruel and unusual punishment on a person. failure to intervene by the other officers to stop this makes it quite obvious there is a failure to train and supervise these officers ...if I'm this person I sue with a 42 usc. 1983 civil rights pack and I take it all the way to trial .... don't settle w em because if you do then the cops that did this can go right down the road to the next county and do the same exact shit again
