By law, the minute you ask to see the warrant, they have to produce it. They can't say they have a warrant. And say it's, oh, it's in my car, no, no, no, no, no, no, no, no, no by law. They have to have it on their person and produce it to you, saying that they have a work for your arrest, they can't just say we have a warrant for your arrest and arrest you. They have to have the paperwork.\n Just saying they have a warrant is not good enough. Your own lawyer will tell you that.

All these judges and lawyers in the comments. They don't give one damn why the police were there. This is the woman who worked for Jody Hildebrant. The partner of Ruby Franke who had just been arrested for child abuse. They certaintly had the right to take the children after the condition of the two in the house. This woman used the girls to clean her home. Said she had no idea what was going on. She lied! she knew exactly what was going on with Ruby and Jodi. So to all of you arm chair lawyers. Do some research about a situation before spitting out opinions. JS

Why would you leave an arrest warrant in the car when your going to arrest someone? Seems suspicious.

As an American we are damned lax on our rights and the law. I’m a retired 61 y/o male, not college educated, and have nothing beyond speeding tickets. I know this scenario was incorrectly done, and the couple were not aware. Sad, but this is more usual and not a ‘one off’.

"It's in my car."? Why didn't you bring it to the door? You brought your daggone handcuffs, what made you think you wouldn't have to show a citizen in her home your warrant ? Never open the door.

Read these insane posts- law enforcement does not randomly stop by- astounding how many fools are yakking about not complying or anti- cop- vs caring one ounce about why they are there or concern for the child- pathetic- no wonder the crime is what it is

I would not comply without a warrant. Call the Police 👮 for verification. (I’m 99% of the time on the side of the Police, but this is fishy without producing a warrant.)

who leaves the paperwork in their car?

Yes, a police officer can detain you if they have "reasonable suspicion" that you are involved in criminal activity, which allows for a brief, temporary stop for investigation. This is a temporary suspension of your freedom, distinct from an arrest, and is based on specific facts and observable circumstances, not just a hunch. During a detention, you are not free to leave, but you can ask if you are being detained and state that you wish to remain silent.

This is so sad, you can tell she is 100% confused and scared. The officer was nice but he also needs to learn basic manners. By law they can not place her under arrest till they produce the warrant. Also they must tell the person what the warrant is for and about.

For anybody who doesn’t wanna do the research. Arrest Warrants •Police do not have to show you the physical warrant before arresting you. •They must tell you there is a warrant and what it’s for. •After the arrest (especially once you’re booked or at the station), you have the right to see the warrant. •If the arrest happens at your home, officers generally need to show or at least state the warrant exists before entering (unless there’s an emergency or you let them in).

I remember probably about 30 years ago. My son called the police on me. He was upset I wouldn't purchase a $175.00 pair of jeans. Let's just say. He never did it again.

the police said the warrant is in the car so why wouldn't you bring it then he said he explained why she's being arrested and he didn't explain anything he said he's taking both her and the daughter in This sounds so shady I'm sure it's not how it's done I truly hope they weren't harmed

In Louisiana, an officer is not required to have the physical arrest warrant in their possession at the time of the arrest. However, the officer must still inform you of their authority and that a warrant has been issued for your arrest, unless doing so would imperil the arrest or you resist or flee. If you request to see the warrant after your arrest, the officer must show it to you as soon as practicable.

A cop does not have to provide a warrant when arresting an individual at their home but they have to give you a copy when booking you.
