A blood draw, without a warrant, is just a request. While the officer may have jurisdiction on the roadway or traffic scene, he has no jurisdiction to compel anyone working in a hospital by what he would consider a lawful command. And furthermore, if anyone did the blood draw without a warrant, it's not evidence that can be used in court.
No the police officer and his department should be sued because you can’t force anyone or arrest him because he doesn’t want to do the blood draw . I would as a former military police. I would just go to his supervisor or the attending supervisor and request it

First off it is illegal for any Dr or nurse to do a blood draw against the persons wishes without a court order. This nurse is doing his job to the letter of the law. Police are not above the law and this arrest would have been nullified by any judge.

I definitely feel like we're missing a huge part of the story here because I seriously doubt a medical professional would refuse to draw blood unless it was a very good reason especially if they're going to get arrested for it

A similar incident occurred a while back a police chase ended in a death The police officer wanted blood from a person that was hit but was not in the chase he was unconscious the nurse explained why that was impossible He arrested her he was fired and the nurse sued his department
Although, the cop may or may not have a warrant. They do have the right to draw blood. That’s not the argument here. Although they have the right, they do not have the right to demand someone to do it. They should have asked a different person or a nurse. This guy will have the charges dropped and could sue for failed imprisonment.

Per hospital policy they can’t draw blood from anyone in custody without a warrant.
although the officer may hsve reasonable suspicion to believe the driver was under the influence, the hospital cannot draw blood for this test unless the patient consents or the officer has a warrant. it would appear that the officer most likely had neither. we all know you can stink to high heaven with alcohol and refuse to take a breathalizer, and obviously can decline a blood draw also.

This is utter BS. In reality, this is LE trying to force the RN to take blood from a patient without consent. Because the RN refuses to violate his patient's right to privacy (and refuses to follow the cop's order), the cop is arresting him. It's a real shit-heel move by the cop. And this very exact scenario has been repeated in hospital emergency rooms for years. The cop needs a warrant, but is trying to shortcut the process by forcing the nurse to pull a blood sample.

He was prob following hospital policy. The hospital should be backing him up. It’s not his fault the other driver died. He should not lose his license. I’m an RN of 42+ years. The nursing board will investigate his actions or lack thereof. If found that the nurses rights were violated he has a lawsuit against the officer and the police department.

He should have his license revoked indefinitely should never be able to practice in healthcare ever again you should face some serious charges too for impeding an investigation, and also obstruction of justice. And I would give him multiple felonies. And he should do prison time for this as well because this is a serious charge because he is protecting somebody who killed somebody so absolutely throw him in prison and make sure he cannot practice in any capacity at any healthcare institution or facility for the rest of his life

We saw this happen a couple times in Alaska, and the officer lost his job and had a huge lawsuit against him personally. There was a qualified immunity. It cost the officer at six figures.
