This happened at the University of Utah Hospital in 2017. An officer wanted to do a blood draw on a suspected DUI patient who was unconscious, and the nurse refused without a warrant or patient consent. The officer was later fired, his superior was demoted, and an apology was issued to the nurse and the hospital. The nurse received a $500,000 settlement from the Police Department and the University.
OK geniuses. she was not wrong. Blood draws are an invasive procedure and require the patients permission. without that permission, a warrant or court order she would have been violating an unconscious patients rights instead of protecting them. i think people that stand by their values, ethics and professional codes are admirable.
Chandra: Please don't call the police pigs. They are doing what they think is right. They put their lives on the line everyday. Obviously it appears they messed up if the nurse received some kind of settlement. Let's hope you don't need the "pigs" one day. For crying out loud have some respect for authority. We have enough activists trying to bring this country down.

what was the charge? they arrested her on? I am a BIG supporter of Police but this appears to be an attempt to bully the nurse into violating the law under the threat of arrest. The nurse rightfully refused. Had she done it, she would have been the one being sued

Two police in Wisconsin arrest my disabled son who has a serious spinal core injury because he could pass a sobriety test. He explained to them that he would do everything he can physically do, but some of the commands he definitely couldn't do, without losing his balance and falling... because of his disabled. They roughed him up, dragging him into the squad car and took him to the hospital for a blood test. Thank God they didn't cause more damage to his spine. The test came back proving he had no alcohol in his system. They also charged him for having his medical Marijuana in his car while traveling back home from his visit to see me... even though he has a medical marijuana card. Some cops are too egotistical and some are overtly racist and their patterns prove it. Those cops shouldn't be on the police force. They are actually part of the the problem, not the solution.

Being a nurse, you need to protect your hard earned license. She was right to stand her ground and not be bullied into breaking the law. Not only that, the patient was unconscious and could not give consent. Suspicions from the officers will come into play in court even if the blood does not. We nurses are taught to do the right thing and advocate for our patients. That does not mean we support, or agree with what this guy did, but when someone is under our care, their misdeeds don’t matter. Following laws, and promoting safety for patients and staff is our priority, and moral duty.
I thought that if you're unconscious then its up to person with poa, & if they're unavailable its upto the authorities, and also the hospital. sometimes things have to follow chain of command, the law does not apply all the time. if they have to id me or do tests then I would hope that they would do whatever is necessary to get info they need. I have a lot of health issues and somethings I cannot have, if they do a blood & finger test they will find that out. 🙏

It’s illegal to have a blood draw unless the patient agrees or they have a warrant. Cops to lazy to get a warrant so try’s to blame the nurse over control issues. Where the nurse knows hospital policies and attorneys have to work it out. Cops would have lost in court on the person they wanted the blood draw from. The defense attorney would have noticed what the cops did and they would try to have that case thrown out of court. All the cops needed to do was get a warrant from a judge for a blood draw. Cops messed up

Authorities need to do some back round research, r u kidding me? And, why is she denied the orotection of due process? You call urselves cops, and u dont follow procedure? I've been a nurse for 49 years & worked ER for 4 years. When a patient comes in unresponsive, you do draw blood for drugs & alcohol plus other labs, EKG & chest X-ray. Your job is to get them conscious.
I would want her to be my nurse, protecting my rights.

Emergency room... what's the first thang they do when you go in? They start taking your shit. They gonna know if you there seeking drugs or if you really need them. If he was responding I would assume they take his shit and run a scan of his head to make sure nothing was bleeding on the inside. I mean your suppose to save not withhold.

The nurse was following hospital protocol. The despicable cop demanded she cooperate. The nurse stated hospital protocol, and the cop did not cooperate. The nurse absolutely deserves the Settlement money. The money is irrelevant , the important lesson here is the nurse won her case and the cop got what he deserved. How many patient’s went without the nurses care while she was being detained by this incompetent cop ? She was doing her job, the cop was not.

It sounds like a training issue. They had a DUI suspect, but she has an oath and regulations. She might have lost her license. It didn’t have to come to this.
this is a short video, hard to tell who is in the wrong without the back story. the police will require blood to be drawn following a suspected DUI. especially if the person is unconscious they want it done asap. a warrant is not always required. depends on what state your in as well. dont drink and drive there wont be any problem. I would want a nurse like her though if im unconscious and people want to do things to me without my permission.

My daughter was in an auto accident, ambulance arrived first then Police. Police knew he couldn't touch her because paramedics got there first. I ran to the hospital while I waited for the Hospital to work on my daughter and this 6'4" Police officer with a gold tooth asked me if I was the mother I said yes why? He said he suspected DUI but his hands were tied because he didn't get there first. I didn't even know if my daughter was alive, he was rude, cold and arrogant but he knew the Law. This nurse was absolutely correct, the Police were wrong in this situation.
