I don't know why he is deflecting. He belongs to the Executive Branch, he recieves direction from the Office of The President. Additionally, he can be removed at any time from his position by The President. He can simply state that and then explain that while this is true, he is under oath to protecting the Constitution. This is true of anyone who works for the Federal Government.
