Passed by the Senate on June 8, 1866, and ratified two years later, on July 9, 1868, the Fourteenth Amendment granted citizenship to all persons "born or naturalized in the United States," including formerly enslaved people, and provided all citizens with “equal protection under the laws,” extending the provisions of the Bill of Rights to the states. The amendment authorized the government to punish states that abridged citizens’ right to vote by proportionally reducing their representation in Congress. It banned those who “engaged in insurrection” against the United States from holding any civil, military, or elected office without the approval of two-thirds of the House and Senate. The amendment prohibited former Confederate states from repaying war debts and compensating former slave owners for the emancipation of their enslaved people.

The constitution disagrees with MAGA. “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws:” via the Due Process Clause of the 14th amendment. Notice the difference in language between CITIZENS and PERSON. The language is deliberate, meaning that ALL PEOPLE on our soil must be afforded the right to due process. They don’t have to see a judge if they’re immediately deported from a border crossing without having entered the country, but if they’re in the country and arrested, they have a right to see a judge per the US Constitution.

He’s not wrong. If a foreign alien enters the USA without due process, there is nothing to due process before throwing them out. Entering using due process is required to get documents proving an asylum claim, TPS, refugee status, or some other humanitarian exception to the standard foreign alien entry procedure. If a foreign alien can’t present such documents, there is no legal due process to perform. It’s beyond a reasonable doubt they didn’t enter using due process. It’s deportation time post haste.
