The Constitution does have provisions for undocumented individuals. However, they can be held in custody until their court date. Some would rather self-deport than spend 10yrs in custody waiting on their due process. 😂

The Senator should know this. “Due Process” Doesn’t Always Mean a Full Court Hearing. The Supreme Court has ruled that what counts as "due process" depends on the context. In immigration law, due process can mean: A brief screening, A chance to make an asylum claim, A review by an officer — not necessarily a full judge-led court hearing. So long as the person has some opportunity to be heard (even briefly), courts often consider it legally sufficient — even if it seems minimal. In the past, courts have generally deferred to the Executive on immigration enforcement until Trump. Now, they seem to think they are the executive branch. In the Immigration and Naturalization Act, it is against the law for District Judges to hear cases of immigration so all of these district judges that do so are breaking the law.
