But watching the video, he did confront him about stealing and the old man did pull out a pistol. And I'm sorry, but if you pull out a weapon on me. The shooting: In response, Powell drew a knife and an airsoft gun, but video shows Timm stepping back, pulling a real handgun from his bag, and shooting Powell once in the chest. Victim's condition: Powell was critically injured but survived the shooting. He was treated at Harborview Medical Center and has since been released to recover at home. Suspect arrested: Timm was arrested at the scene and charged with first-degree felony assault. The defense's claim: Timm's attorney has claimed self-defense, but prosecutors argue this does not apply since Timm initiated the confrontation.
