This happened at the University of Utah Hospital in 2017. An officer wanted to do a blood draw on a suspected DUI patient who was unconscious, and the nurse refused without a warrant or patient consent. The officer was later fired, his superior was demoted, and an apology was issued to the nurse and the hospital. The nurse received a $500,000 settlement from the Police Department and the University.

OK geniuses. she was not wrong. Blood draws are an invasive procedure and require the patients permission. without that permission, a warrant or court order she would have been violating an unconscious patients rights instead of protecting them. i think people that stand by their values, ethics and professional codes are admirable.

She did not have the right to refuse a lawful request for an officer. I do support nurses, but I support law-enforcement as well. It’s an unfortunate situation being gaslit by people that can’t stand the police. I stand with law-enforcement and especially I stand with Ice.
Apparently this nurse was abiding by our constitution & refusing to succumb to these officer’s tyranny. Our 4th Amendment protects us from unreasonable search & seizure, meaning the officers needed a warrant -based on probable cause, they need EVIDENCE of a suspected crime then submit an affidavit to a judge before the judge signs the warrant to collect a blood sample. Our founding fathers created this amendment in part because tyrannical redcoats used to unexpectedly burst into homes and search them or perform terry stops etc to find evidence without probable cause or without there being any evidence to support the probable cause to prompt the search in the first place. That’s what these police are doing. This is America, we have a constitution & laws that govern these procedures & institutions to protect EVERYONE involved. Being a nurse, you need to protect your hard earned license. She was right to stand her ground and not be bullied into breaking the law. Not only that, the patient was unconscious and could not give consent. Suspicions from the officers will come into play in court even if the blood does not. We nurses are taught to do the right thing and advocate for our patients. That does not mean we support, or agree with what this guy did, but when someone is under our care, their misdeeds don’t matter. Following laws, and promoting safety for patients and staff is our priority, and moral duty.
The responsibility/liability should have been found with her residing shift supervisor, as her nursing license would have been at risk by this request. We don't have rights until they come into question, such as in a court of law. He said, she said. None of us. Depends on the ringmaster of the 3 ring circus. We are just clowns in the show. Two police in Wisconsin arrest my disabled son who has a serious spinal core injury because he could pass a sobriety test. He explained to them that he would do everything he can physically do, but some of the commands he definitely couldn't do, without losing his balance and falling... because of his disabled. They roughed him up, dragging him into the squad car and took him to the hospital for a blood test. Thank God they didn't cause more damage to his spine. The test came back proving he had no alcohol in his system. They also charged him for having his medical Marijuana in his car while traveling back home from his visit to see me... even though he has a medical marijuana card. Some cops are too egotistical and some are overtly racist and their patterns prove it. Those cops shouldn't be on the police force. They are actually part of the the problem, not the solution.

It’s illegal to have a blood draw unless the patient agrees or they have a warrant. Cops to lazy to get a warrant so try’s to blame the nurse over control issues. Where the nurse knows hospital policies and attorneys have to work it out. Cops would have lost in court on the person they wanted the blood draw from. The defense attorney would have noticed what the cops did and they would try to have that case thrown out of court. All the cops needed to do was get a warrant from a judge for a blood draw. Cops messed up

The nurse was following hospital protocol. The despicable cop demanded she cooperate. The nurse stated hospital protocol, and the cop did not cooperate. Most cops just think bc they tell someone to do something they should. They have the mentality of I’m in control and I just gave you a lawful order but it’s not always right or true. Then the cops pay the price as it should be. You’ve heard no one is above the law including the law itself.

I've been a nurse for 49 years & worked ER for 4 years. When a patient comes in unresponsive, you do draw blood for drugs & alcohol plus other labs, EKG & chest X-ray. Your job is to get them conscious.
