first off NONE OF YOU KNOW WHAT TRANSPIRED BEFORE THE VIDEO STARTED. - this could have arisen from a traffic stop or a citizen call or the dred head dude could have been DUMB ENOUGH to be smoking MJ as he drove and the cops smelled it( yeah we got idiots who smoke up and drive and NHTSA has documented that 70% of DUI/ DWI drivers are under the influence of MJ also!) probable cause to search can be established by smell as well as observation- and once inside that vehicle, anything found in the search - illegal firearms other narcotics , evidence of other crimes is seizable. Short of a legit observation and reasonable suspicion? yeah a search warrantcis required.

No not always. The Deputy said he could smell Marijuana coming from the car. That gives the Deputy probable cause to search without vehicle owners permission. Anything he finds can be collected and he can be prosecuted for it.

the smell of marijuana is not a legal reason to search a vehicle People v. Hall (2020) and People v. Lee (2019): most cops are not aware of this. so they still initiate illegal searches based upon it

THIS IS SUPREME COURT STUFF. $1,000 SAID THEY FOUND SOME SMOKE INSIDE THERE. WE DIDN'T SEE THE REST OF THE VIDEO. HE MIGHT EVEN HAD SOME ILLEGAL FIREARMS. Last words. Don't smoke pot in your car when driving. that's stupid. If you don't like getting pulled over and arrest, Do not commit illegal activity while driving.
