I don't think she can sue him, it's public area, skateboards are allowed there and it was her fault for ignoring him and huffing off, had she taken a moment to accept his apology before walking off he would have most likely had time to grab his board. everything happened to fast and the video will show he apologized had intentions of hurting her and her arrogance caused herself this situation. of course him not skating at all would have helped.
