The suspect was down and the threat from that suspect had ceased. The clerk should've removed the weapon and, after the other suspect was no longer a threat, then called the police. Then, continue to keep the injured suspect at bay until the police showed up. But no, he continued to murder him. It's no different if one breaks into someone's home while the homeowner is at home and armed. If the homeowner manages to stop the threat but decides to shoot after the fact and kill the home invader, the homeowner can be charged with murder then.
