Warning shots aren't legally at least here in NYS. What if it ricochets or hit an unintended target. What goes up comes down. It's reckless endangerment. If a threat is running away you can't shoot them.

Don’t ever say you fired a warning shot. You shot you happen to miss them and because they fled, you didn’t keep shooting. If you pull a gun, you can’t pointed at somebody and threaten them. You must pull the trigger. I don’t know if we agree with this. I think there are circumstances where you could hold somebody at gunpoint. But concealed weapon permit holders are told if you pull you use.
